Former Detroit Mayor Back In Jail

Posted: 25 May 2010 12:01 PM PDT

The famously corrupt politician who ran Detroit for six years before getting criminally convicted will go back to jail for violating the terms of his probation by hiding assets to avoid paying the city $1 million for his felonious antics.

The storied career of Kwame Kilpatrick keeps providing fodder for local media even though he moved to another state last year to start fresh after serving four months in prison. In 2008 Detroit's self-described "Hip Hop Mayor" pleaded guilty to obstructing justice by lying under oath about an extramarital affair with a staffer at a whistleblower trial. He also got five years of probation, was ordered to pay $1 million in restitution and forced to turn over his state pension to the city of Detroit.

This week a Wayne County judge determined that the scandal-plagued politician, who is the son of Michigan Congresswoman Carolyn Cheeks, has been "maliciously" hiding assets to avoid paying his debt to the long ailing city he left in shambles. That constitutes a probation violation, which the judge says will land the disgraced lawmaker in jail for 18 months to five years.

At the hearing Kilpatrick begged the judge to keep him out of prison with an emotional speech in which he proclaimed to be a changed man who would never hide money from the court. As he implored for mercy however, the former mayor revealed that he had settled into a $1 million home outside Dallas, continued to drive expensive cars and spent thousands for his wife to have cosmetic surgery.

No wonder the visibly irritated judge sent Kilpatrick to the slammer after telling him that "your testimony in this court amounted to perjury." The once rising star in Michigan's Democratic circles showed a lack of candor, remorse, humility and forthrightness, the judge further said before ordering the court officer to handcuff Kilpatrick.

It was a dejavu moment for the self-destructive former mayor who has been handcuffed on numerous other occasions. Though lying under oath to cover up his extramarital affair with a city staffer ended his career, Kilpatrick has committed numerous other crimes. He orchestrated a secret $9 million settlement with wrongfully fired cops who came close to exposing his undercover romance, was charged with two felonies for assaulting a sheriff's detective trying to serve a subpoena on one of his shady friends and previously violated his probation in another case.

Kilpatrick's troubles began shortly after he took office in 2002. He spent a great part of his first tenure partying with strippers at the mayor's mansion and got busted for charging hundreds of thousands of dollars on his city-issued credit card for personal travel, meals and entertainment. He also used $25,000 of city funds to get his wife a fancy sports utility vehicle at a time when Detroit was in a deep financial crisis and thousands of city jobs were being cut.

After completing his prison sentence last February, an old buddy hired Kilpatrick as a medical software salesman at a Dallas-based company called Compuware Corporation. Kilpatrick made $120,000 a year but got fired this week after his probation got revoked. A Michigan state congresswoman, who assures that jailing more African-American males has done little to stem crime, criticized the sentence as too harsh. It shows that there is "no mercy in society and no grace in the judicial system," Detroit Democrat Shanelle Jackson proclaimed.

JW Sues DOJ for Documents Regarding Decision to Dismiss of Lawsuit against New Black Panther Party for Self-Defense

Posted: 25 May 2010 11:01 AM PDT

Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it has filed a Freedom of Information Act (FOIA) lawsuit against the Obama Justice Department to obtain documents related to the agency's decision to dismiss the claims against several members of the New Black Panther Party for Self-Defense who were accused of engaging in voter intimidation during the 2008 presidential campaign (U.S. v. New Black Panther Party for Self-Defense).

Judicial Watch filed its original FOIA request on May 29, 2009. The Justice Department acknowledged receiving the request on June 18, 2009, but then referred the request to the Office of Information Policy (OIP) and the Civil Rights Division. On January 15, 2010, the OIP notified Judicial Watch that it would be responding to the request on behalf of the Offices of the Attorney General, the Deputy Attorney General, Associate Attorney General, Public Affairs, Legislative Affairs, Legal Policy, and Intergovernmental and Public Liaison.

On January 15, the OIP also indicated that the Office of the Associate Attorney General found 135 pages of records responsive to Judicial Watch's request, but that all records would be withheld in full. On January 26, the OIP advised Judicial Watch that the Office of Public Affairs and Office of Legal Policy completed their searches and found no responsive documents. On February 10, the Justice Department's Civil Rights Division indicated that after an extensive search it had located "numerous responsive records" but determined that "access to the majority of the records" should be denied. On March 26, the OIP indicated that the Office of Legislative Affairs and the Office of Intergovernmental and Public Liaison completed searches and found no documents.

Judicial Watch appealed the determinations of the Office of the Associate Attorney General and the Civil Rights Division. To date, Judicial Watch has received neither a response regarding searches conducted by the Offices of the Attorney General and Deputy Attorney General, nor responses to its two administrative appeals prompting its lawsuit. The U.S. Commission on Civil Rights, an independent, bipartisan unit of the federal government charged with investigating and reporting on civil rights issues, has also initiated a probe of the Justice Department's decision to dismiss its lawsuit.

The Justice Department originally filed its lawsuit against the New Black Panther Party for Self-Defense and several of its members following an incident that took place outside of a Philadelphia polling station on November 4, 2008. A video of the incident showing a member of the New Black Panther Party for Self-Defense brandishing police-style baton weapon was widely distributed on the Internet. According to multiple witnesses, members of the New Black Panther Party for Self-Defense attempted to block access to polling stations, harassed voters and hurled racial epithets. Nonetheless, the Justice Department ultimately allegedly overruled the recommendations of its own staff and dismissed the majority of its claims.

"The Obama administration owes the American people an explanation. How can the Justice Department dismiss a clear-cut case of voter intimidation involving the use of a weapon? Are voting rights important at the Justice Department? If there is nothing to hide, then Eric Holder should release this information as the law requires. And this is just one more example of how Obama's promises of transparency are a big lie," said Judicial Watch Tom [...]

Illegal Immigrant Rapist Had Been Deported 9 Times

Posted: 25 May 2010 06:23 AM PDT

In what appears to be a growing national trend, an illegal immigrant with an extensive criminal record and multiple deportation orders remained in the U.S. long enough to commit yet another atrocious crime.

The tragic case in Washington State marks the latest of many examples illustrating the government's inefficiency in keeping dangerous illegal aliens out of the United States, even when they have well-documented criminal histories and federal orders to leave the country.

In this case a Mexican national with an extensive criminal record and nine deportation orders raped a woman in Edmonds, a picturesque waterfront town famous for its views of the Olympic Mountains rising above Puget Sound. The illegal immigrant (Jose Lopez Madrigal) was first deported in California more than two decades ago and has since been convicted of a multitude of violent crimes, including armed theft, sexual assault and drug-related offenses.

The crimes were committed in different states—California and Colorado among them—and Madrigal had a staggering number of encounters with law enforcement in the last two decades, according to the local news report that broke the story of his multiple deportations. When he got arrested this last time, it took authorities longer than usual to learn his real identity because he had well over two dozen aliases.

The level of incompetence among federal immigration authorities in this case would be comical if Madrigal's crimes weren't so heinous. After the first deportation in 1989 for using a firearm to commit theft, Madrigal got deported several more times in the next few years. In 1999 he was deported three times in a four-month period after drug-related arrests. After a similar offense in 2000 he got deported yet again and in 2002 he got deported after pleading guilty to sexual assault in Denver. In 2003 Madrigal got deported three more times.

It would seem like a huge joke if the illegal immigrant didn't brutally rape a woman last week. Evidently ashamed, officials at the Homeland Security agency (Immigration and Customs Enforcement—ICE) responsible for removing such thugs refuse to comment on the case. One criminal justice source quoted in the news report says Madrigal is a "poster boy" for the federal government's ineffectiveness at keeping the most serious criminal aliens out of the United States.

It's not like this is an isolated incident. In the last few years alone similar cases have rocked the nation. On Mothers' Day last year a 17-year-old girl was murdered in Nevada by an admitted illegal alien gang member who had been convicted of a felony years earlier and deported.

A year earlier authorities in Arizona discovered that a serial rapist who targeted young girls was a twice deported Mexican who lived and worked in the U.S. despite his documented history of drug charges. He was caught only because the sheriff's department in Arizona's largest county (Maricopa) bothered to confirm his immigration status.
