A U.S. Senator, who recently lost a powerful committee chairmanship amid a corruption scandal, leads the Senate in using "private bills" to keep illegal immigrants in her district from being deported.

Democrat Dianne Feinstein, a member of the Senate Judiciary Committee, is the lawmaker who most abuses the rarely used method to block the deportations of illegal aliens in her northern California district. Private bills are seldom introduced because, unlike public bills, they only benefit specified individuals and are therefore viewed as special treatment susceptible to fraud.

Feinstein, a former San Francisco mayor elected to the U.S. Senate in 1992, has introduced 40% of this year's private bills, according to a news report that highlights several of the illegal aliens that the senator has helped evade deportation. The most recent is a Philippine woman ordered to leave the country after two decades. Feinstein intervened after federal courts denied the woman's request for asylum. 

The senator has also helped a deported family of Egyptians that overstayed its U.S. tourist visa by more than a decade, a Mexican family that has lived in her district illegally for 20 years and an Asian couple that entered the country more than 25 years ago as tourists and never left. Feinstein claims her private bills help families or individuals, like these, who face "exceptional" circumstances because they would encounter "enormous hardship" if sent back to their home countries. 

Feinstein, who is among the wealthiest members of Congress with a net worth of $42.6 million, is no stranger to scandal. A few months ago she was forced to resign as chair of a powerful military construction committee after reports that for years she abused her position to award her husband's companies billions of dollars in government contracts. 

A few years ago Feinstein introduced a delusional law to give 1.5 million illegal immigrant farm workers and their relatives United States citizenship by granting them immediate legal residency. Feinstein and several lawmakers who joined her in the failed bid claimed the measure was necessary to provide a labor pool for the country's multi billion-dollar agriculture industry.

The Jordanian who vowed jihad against Americans before trying to blow up a Texas high rise was living in the United States illegally even though he had been arrested by a local law enforcement agency that neglected to refer him for deportation. 

In yet another shameful example of how illegal alien sanctuaries across the U.S. enable dangerous felons, a local law enforcement agency with a don't-ask-don't-tell immigration policy freed a would-be terrorist after an arrest. In similar cases nationwide local police departments have permitted dozens of illegal immigrants to commit violent crimes—including murder and rape—against innocent Americans by releasing them instead of deporting them. 

In this case the FBI intercepted the bombing of a 60-story office building in downtown Dallas. The Jordanian illegal alien (Hosam Maher Husein Smadi) who nearly pulled it off lived in a little Texas town called Italy, located in Ellis county about 45 miles south of Dallas. Earlier in the month, Smadi had been arrested by the Ellis County Sheriff for not having a driver's license or insurance. He paid a small fine and continued plotting his terrorist attack.  

In conversations with FBI agents posing as al-Qaeda operatives, Smadi pledged allegiance to Osama bin Laden, said he came to the U.S. to wage jihad (holy war) against Americans and told agents he was targeting military recruitment centers but eventually settled on financial institutions because security was more lenient. Late last week he was arrested for trying to detonate explosives loaded inside a sports utility vehicle he had parked outside a Dallas skyscraper. 

Smadi has been charged with attempting to use a weapon of mass destruction. He first caught the attention of the FBI's Joint Terrorism Task Force as a member of an online group of extremists. Smadi stood out based on his "vehement intention to actually conduct terror attacks in the United States," according to the FBI arrest affidavit. In numerous communications with undercover agents, he repeatedly made clear his intention to commit violent acts of terrorism in the name of Islam. 

In the detailed affidavit, federal agents outline Smadi's specific plans and reveal his mindset by listing radical statements he made to undercover FBI employees who are native Arabic speakers. Smadi repeatedly confirms his loyalty to Osama bin Laden, refers to Jews as dogs and vows to target everything that helps America in its war with Arabs. 

Americans should wonder how this jihadist entered the U.S., what government agency failed to detect his presence and why wasn't he intercepted by the small local sheriff department that arrested him just days before he tried bombing a building?

Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it has filed a Freedom of Information Act (FOIA) lawsuit against the Department of Homeland Security (DHS) to obtain documents regarding the government's decision to "reform" 287(g), a federal program that trains local law enforcement officers in illegal immigration enforcement techniques. In July, the DHS announced changes to 287(g), which many believe undermine the program, after DHS Secretary Janet Napolitano ordered a complete review of all border and illegal immigration policies.

Judicial Watch filed its original FOIA request on July 20. DHS acknowledged receipt of the request on July 30 and granted itself extra time to process the request. However, DHS has not abided by its own extended deadline and has not provided Judicial Watch with a date certain when it will provide responsive documents or demonstrate that responsive records are exempt from production. By law, DHS had 20 days to respond to the request. Among the documents sought by Judicial Watch:

  • The new standardized Memorandum of Agreement used to enter into 287(g) partnerships, as announced by Secretary Napolitano on July 10, 2009, as well as any documents containing information on the development of the agreement;
  • All new 287(g) agreements entered into with law enforcement agencies;
  • All documents concerning the decision to standardize the Memorandum of Agreement and/or create new 287(g) agreements;
  • Media and congressional notification plans concerning 287(g);
  • And all email correspondence concerning the new 287(g) agreement between Homeland Security Secretary Janet Napolitano, Border Security "Czar" Alan Bersin, and White House Director of Intergovernmental Affairs Cecilia Munoz, among other government officials.

The 287(g) program has been credited by local law enforcement officers for helping to reduce crime rates. At least 67 local law enforcement agencies currently take advantage of the program, up from 27 in 2006. Nonetheless, government officials seem intent on weakening the program.

"At a time when local law enforcement agencies are reducing crime with 287(g), why has the Obama administration decided to undermine this program? The vast majority of Americans want federal immigration laws enforced. Local law enforcement officers can contribute to this process and they have every legal right to do so. I suspect that 287 (g) is under attack because Obama appointees have an 'amnesty' agenda at odds with enforcing the law. No wonder Judicial Watch can't get any documents," stated Judicial Watch President Tom Fitton.
